Welcome to Keeps & Tales (KT). These Terms and Conditions (“Terms”) explain how you can use our services and what we expect from each other. By using our website, subscribing to our emails, or purchasing our services, you agree to these terms.

1. Eligibility

You must be 18 years or older to use Keeps & Tales. If you’re under 18, you cannot access or use our services.

2. User Accounts and Responsibilities

2.1 Understanding Our Process

2.2 Account Security

• Keep your login information confidential.
• You’re responsible for all activity on your account.
• Tell us immediately if someone uses your account without permission.

2.3 Digital Preview & Approval

• You’ll access your digitized artwork through your account in the Digital Art Gallery.
• We’ll email you when your digital preview is ready.
• You have 14 days to review and approve your digital preview.
• We cannot complete your order without your approval.

3. Pricing & Payment

Our service requires two separate payments:

3.1 First Payment: AED 98 (KT Box)

What it includes:

• Sturdy KT Box & protection materials (transparent bag, seal sticker).
• Instructions for organizing and returning your box.
• Prepaid return shipping label (UAE only).

3.2 Second Payment: Photography & Production

What it includes:

• Professional digitization, editing, and enhancement.
• Production of your custom book(s) or mosaic(s).
• Shipping of final product (UAE only).

Pricing Rules:

• Based on the number of pieces sent and products ordered.
• Every piece you send is included in your final cost.
• Removing pieces after submission will NOT reduce your price.

4. Cancellations

4.1 Account & KT Box Cancellation

• Same-day cancellation: Full refund minus 10 AED cancellation fee.
• After box has shipped: No refund available (98 AED is non-refundable).

4.2 Cancellation During 2nd Payment

Services may be canceled, but digitization fees apply (starting at 150 AED for the first 30 images). Requests for the return of physical artwork will incur shipping costs.

5. Credit Note Eligibility

Since we create custom products, we provide credit notes (equal to the amount paid) instead of traditional refunds in specific situations.

5.1 Eligible Scenarios

• Service not received within the promised timeframe.
• Accidental double charges.
• Technical limitations preventing completion.

5.2 Non-Eligible Scenarios

• Changing your mind after purchase.
• Using only part of the service.
• Subjective dissatisfaction with content.

6. Security of Your Personal Information

6.1 Data Protection Measures

We use secure systems with restricted access. Only authorized employees can access information for order identification, communication, and shipping fulfillment.

6.2 User Responsibilities

You must keep your password confidential. No internet system is 100% foolproof; notify us immediately of any security breaches.

7. Intellectual Property

7.1 Company Assets

All content, branding, and materials associated with Keeps & Tales are the exclusive intellectual property of the Company, protected by UAE and international laws.

7.2 Feedback

Voluntary suggestions or feedback may be used by the Company without compensation.

8. Limitation of Liability

8.1 Damages

The Company is not liable for indirect, incidental, or consequential damages (loss of revenue, etc.).

8.2 Liability Cap

Total liability shall not exceed the amount paid for the specific product or service.

8.3 Artwork Handling

While we exercise reasonable care, liability is limited regarding pre-existing fragility, normal wear and tear during digitization, or inherent deterioration of materials.

9. Indemnification

You agree to hold Keeps & Tales harmless from claims arising out of your use of the services, violation of these terms, or any fraudulent act committed under your account.

10. Force Majeure

Neither party is liable for failures due to circumstances beyond control (natural disasters, pandemics, war, shipping disruptions, etc.).

10.1 Notice & Termination

If a force majeure event exceeds 60 days, either party may terminate the order. Prepaid services not yet provided will be refunded minus costs already incurred.

11. Changes to Terms

We reserve the right to modify terms. Active orders will be completed under the terms present at the time of purchase. 30 days’ notice will be given for material changes.

12. Dispute Resolution

12.1 Initial Resolution

Please contact hello@keepsandtales.com first to resolve issues directly.

12.2 Mediation & Arbitration

If unresolved after 30 days, disputes may proceed to mediation or binding arbitration through the Dubai International Arbitration Centre (DIAC).

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of UAE courts.

14. Service Termination

14.1 User and Company Rights

You may cancel anytime. We may suspend accounts for violations, fraud, or abuse of staff.

14.2 Post-Termination Data

Digital gallery access ends immediately. Data is kept for 30 days for reactivation purposes before permanent deletion.

15. Shipping & International Service

15.1 UAE Domestic Shipping

Free shipping for completed orders in the UAE. Standard delivery is 2-3 business days after final approval.

15.2 International Limitations

International shipping is not currently available. We only ship physical products within the UAE.

15.3 Damaged or Lost Shipments

If your order arrives damaged, contact us within 7 days. We will work with the carrier to resolve the issue or provide replacements.
